Debt Collection - Israel

1. Is a court judgment needed in your country to enforce debts? Yes.
For collection purposes - a bounced cheque is considered as a conditioned court judgment.
2. On average, how much does it cost, (court fees) to issue debt collection proceedings? 1% of the value of the debt. There are additional charges for several collection proceedings such as attachments, sale of debtor's property, etc.
3. Is there a procedure for claims that are not defended? Any judgment afforded in an undefended claim can be vacated within 45 days from the date of service. Unless vacated, such a judgment is considered to be a regular judgment.
4. What is the average time from issue of proceedings to judgment, if not defended? Not less than 30 days.
5. What is the average time from judgment to the first enforcement method by the court? Usually, not less than 20 days.
6. Are any special procedures required to enforce judgment? No. However, it is customary to send a notice to the debtor specifying the intention to initiate enforcement proceedings.
7. Can you recover legal costs from the Defendant (in whole or in part)? Yes - statutory legal costs can be recovered in full.
8. Can assets of the Defendant be seized to enforce judgment? Yes. However, there are some limitations as to essential personal belongings, dwellings and salaries.
9. If Yes how much does this cost (eg court fees)? It depends on the property involved. Usually the governmental fees are not more than EURO 30 + statutory legal fees.
10. Are these costs recoverable (from the assets seized)? Yes - in whole.
